Their problems doesn't make me smile here. I want solutions to my problems.
I couldn't agree more, how come any immigration rules in britan should have any thing do with USCIS ? any time we have a problem with USCIS or in general US policy there are few people who want to jump in and comapre the rules and other stuff with rest of the world. This is not how an issue should looked at people came here because they thought this country encourages immigrants what I want see is let this country talk the talk and walk the walkif they don't want to give green cards or fix H1b porblems just say we no longer need any immigrants we have gained every thing we want from the immigrants and we are ok now when we need talent and work force we will call everybody , I am sick of this I could go on but .....

There have been questions raised regarding the way numbers have been provided to the China and India in the Employment Second preference categories beginning in April. Section 202(a)(5) of the Immigration and Nationality Act states that if total demand for visas in an Employment preference category is insufficient to use all available visa numbers in that category in a calendar quarter, then the unused numbers may be made available without regard to the annual per-country limit. (For example: If the second preference annual limit were 40,000, number use by �All Other Countries� were estimated to be only 25,000, and the China/India combined number use based on their per-country limits were 6,000, then there would be 9,000 numbers unused. Those 9,000 numbers could then be made available to China and India applicants without regard to their per-country limits.)
Based on the informaiton available, it was been determined that the demand from �All Other Countries� for Second preference numbers, plus the amount of numbers available under China and India Second preference per-country limit, would be insufficient to utilize all available numbers under the annual limit for this category. Therefore, pursuant to Section 202(a)(5) of the Act, the unused numbers have been made available to China and India Second preference applicants. Since Section 203(e)(1) of the Act requires that such unused numbers be made available strictly in priority date order, the China and India applicants have been subject to the identical cut-off date. As there are more Employment Second preference applicants from India and the Indian applicants may have earlier priority dates, it is likely that Indian applicants will receive a larger portion of the available numbers than Chinese applicants.

I am trying to pay thru PNC Bank. When trying to add IV, there are 2 options. One is With number and the second Without number.

I think it would be without a number. Now that depends on which number? If they need an account number then, yes no account number OR you could use your IV handle as the account number. Different banks have different methods of BILL PAY.

Way better than EB3-I/H1B in US....actually jumping out was the best thing I did before the GC train wrenk. This site keeps me aware of the latest changes in US immigration. After my wife's cad citizenship I might work in US even. Till then myself and wife...combined earn well

How about each one of us does whatever is suitable with common theme being similar letter/concern etc. If we choose clock/cal etc. shortly we will run out them at sites such as amazon, etc. Anyway only some of us will be able to do it...But flowers, letters, fliers are limitless and everyone can send...
So my suggestion is --draft a common themed letter and send the letter along with whatever anyone chooses to send along (with clock, cal, flier or simply letter. But please make sure the fliers are not offensive)...

If you pass substantial presence test and treated as resident for tax purposes, you get the check from IRS. Mots of us file 1040A for taxes. Only few of us do not qualify as residents for tax purposes file 1040NR, those don't get.
If your spouse doesn't work and have a child, then you may qualify as head of household and sometimes get bigger check.
Only few desi's will not qualify for this check but whoever stays here for more than couple of years and filed taxes in 2006, don't worry.

have no hope of getting GC in the next 2 yrs, so we decided to put in our applications for Canada. Took us some time to assemble all the documents, but God willing we will mail the package out next week.

Entire world is turning up against immigration. It is beyond individual/group control to lobby for changes in that area.
It is on the threshold of the time. Right now we as individuals still can make a decision to continue to be in US and wait it out or go back to our home country.
But if this trend continues, I am afraid, some new law will make that decision for us to send us all back. It is just around the corner. Worst part is we can't do a thing about that.
So want to blame anyone, blame your politicians of your native country for creating such a mess that people wanted to move to a different country.
Such thing can never happen. Also, don't lose hope. Look at how the world was before. Slavery, racism, castiesm, untouchability, intolerance, poverty etc.... it has always been a struggle to navigate through all these barriers and we are still navigating.
Basically the attitude is "when my house is burning why should I accomodate these people" - it is how the world is and we have to navigate.

At least I won't give u red dots if you can enlighten us how to get us out of this mess. And yes, we do want our green card so I don't think we can stop the process or stop spending money on that. Also please advise us how to bring all 70K people under one umbrella?
Sanjeev - I personally feel there is no easy solution for this. Our efforts must be well organized and there has to be geniune effort. A lot of people who post here are all frustrated and angered and they channelize their anger and frustration through these forums whereas instead if it is channelized in a positive way - our campaigns will be more effective and we can reach our goals.

We pay tons of fees to USCIS and wait for more than six years for GC and yet some shitty senator who does not know anything about immigration comes and rattles on stage.
The hearing should have started with the Ombudsman reports as a basis. Then the hearing should have asked USCIS for solid data like -
How many applicants from year 2001-2007 are pending? In what year, category, country? (to show the trends of backlogs)
How much percentage of applications were processed on annual basis compared to the limit? What is the inflow and the outflow?
What are the customer satisfaction levels for USCIS?

..We cannot say things like exploitation or make the employers feel ...This is feed for the anti immigratin lobby..You put up stuff like this and they start painting you as their poster boy to show why the whole H1B program should be abolished......If we do conduct a strike ..it would cause no disruption at all..Frankly nobody is indispensible...Striking is equivalent of biting the had that feeds us...

2 tier filing as of now does not allow EAD. it is only to pre adjudicate cases for i-485. Also, it opens a whole bunch of other problems. please read related (old) thread to it on this site.
If as part of 2 tier filing, EAD is allowed, i am all for it. So, we are only asking to get EAD/I-485 filing as soon as I-140 is approved.
