Hi,
1> Presently i'm working for company A and wants to transfer my visa to company B. After transferring my visa to company B, if i don't want to join immediately to company B and want to work for some more time in company A itself. Is this possible? If it is possible how many months i can hold my H1 visa of Company B or Max after how many month i can joinvto company B?
2> Presently i'm working for company A and i had a bond in India with this company an amout of $9000. if i leave the company within 1year I should pay this amount to the company. If i break the bond and join to other company, do i really need to pay this amount. Please help me.

My wife H1B was approved under Consular Processing. She got job offer now and it is a Consulting job to Hire. We applied COS at CSC by Premium processing. Reached application on Sep 28 and Status is Acceptance by then.
1 ) Everything is genuine and in the client letter it is mentioned as 6 Months contract to hire. Are there any posibbilities of getting H1B approved for only 6 months from now.
2 ) Are there any chances of rejection
3) Sincle past week it is under "Acceptance" stage. I know i have to be patient.
4) Can we expect some decision from them this week as client is waiting.
5) At what time CSC updates the case. Is there any particular time they update the case online.

H1b extension will be for rest of the period, in your case 1year + 8 months.

My married daughter from India currently on visitor visa has been here to visit us. Would like to seek extension of her visa by 4-5 months so that she can spend little more time with us. All her immediate family members are in USA and with extended approved stay she can visit all family members and spend more time with old parents. She has 10-year visa given to her in December 2008 when she came for the first time after this visa. Her husband and children are in India.

H1b from non-cap to cap cannot be transfered. In order for you to work in private companies, you need to get new H1b by filing in on april 1 st 2009 which will ahve start date of oct 2009. Untill then you are stuck ..!!!
However you can transfer your present H1b to another non-profit h1b. I know the rules sucks..I ahve been in your place and got H1b this time. Can't wait to to get freedom on oct 1st.

I spoke with TSC Rep today. I called up to re-check what lot of other guys are saying here that TSC no longer is honoring 180 day namecheck rule mandated by court few months back.
TSC Rep said she has no idea about 180 day rule but knows about FBI/USCIS joint effort for clearing name checks pending more than year, 2 years etc.
So atleast, my call suggested that some people at USCIS have no idea about 180 days rule mandaged by court.

With my knowledge, I don't think your current salary should matter for the future employement. But it shouldn't be grossly differrent. One of my friend got his GC approved with H1B salary less than salary mentioned in I140. What I would like to say is not worry to about it much until your attorney says it is a problem.

Do you know, how one could apply for a Visitor Visa without a Sponsorer in the US ?
What documents do they need to furnish ?
As I understand there are a lot of ppl who come to the US who do not have kids/relatives here, what do they have to show if they are just coming to the US for a Visit not work related ?

Hi everyone,
I have come to this form for help of one thing: for a long time I know that when switching jobs using ac21 you need to make sure that the job code is same and job description is similar, i know from my approved 140&perm that mine is 15-1032 (computer engineer),
the job description of both company are 90% same.
But they know nothing about the job code and ask me what is this code and where this is used . Can somebody help me with this?
btw, my old job title is computer engineer, my new title is manager of computer system engineer. is that a problem ? if yes , if I asked them to demote that to computer system engineer leader, is it better?

Hi!
I need to know when can I fly back to US on my H4 visa(valid till 2011 ).
My husband has joined a new job and his H1 B transfer has been filed .
Do I have to wait for new I 797 or Can I just travel on my old H4 visa and
visa transfer receipt notice .( he is filing the H1 transfer by premium processing ) .
His new employer is suggesting me to reenter on old h4 and before my husband
joins their company .
But for me that will be very soon ( not fulfilling the purpose of my visit ).
Any help is much appreciated.:confused:

Your post raises so many questions it is hard to know where to start.
The obvious one is if you do not have an employer, how have you got an H1B visa since it is the employer who petitions for it?
Second thought, where are you right now? Still in your own country or the USA?
In response to your question about a green card. If you are going to follow the employment based route, by definition, you are going to need an employer to get this process rolling. Starting with PERM labor certification.

Thanks for my previous response. I am on H1B and between projects. I have an offer to work for a couple of days for a company other than the one holding my H1B. They said they are not gonna report to the IRS as its an hourly job for 2 days and the number of hours are not going to accumulate enough for the IRS. But they need my SSN or tax-payer ID to run their payroll. I am gonna receive my dues as a simple check (like a rebate check with just the total amount showing up & NOT a paystub). Please let me know if I can work for them or not.
