Hi All,
My wife is currently working on H1B. She recently got her EAD through my GC application (I am the primary applicant). Can she use her EAD to work for her current company who is holding H1B?

Hi,
My H1B was approved with a start date of 12th Dec 2010. However, the paperwork for the position has not been completed as yet by the HR of my employer and now they tell me that the start date of my position will be around the middle of Jan 2011.
This means that I will not get paid till the actual start of my position. So what is my legal status right now.
I have been told that on a H1B visa, If I am not working and getting paid for the position I was approved for, I am illegal.
Please advise me as I still have time to convey the issues to get the paperwork done right. What happens if my H1B start date is the 12th of Jan and my job paperwork shows position and pay from the 15th of Jan?

Effective July 9, 2010, the Department of State revised its visa reciprocity schedule for China to allow for a 12 month, multiple entry visa for H visa applicants. This will allow H-1B visa holders from China to have multiple entries into the U.S. for a 12 month period. As far as I know you do not need to get a new visa stamping. At least, it was like that when I was on F-1. What you need to re-enter is to have I-20 from new school. Check with the school's international students adviser.

Hi,
I am filing the PERM application in EB2 Category. The position needs Bachelors + 5 Years (or) Masters + 1 year. I do have 30 months expereince after finishing my Bachelors degree and 11 months expereince after finishing my Masters degree.
Will I be eligible to file in EB2 as I have Masters degree and more than 12 months of expereince after Bachelors.
My questions is -- How do you count the expereince if its Masters + One year
Will you count one year after finishing the Master Degree completed (or)
Will you count one year after finishing the Bachelors Degree.

I am on EAD and I dont have any current employment, except a good faith future employment offer. I am already in bench more than 4 months and tired of it. I want to travel to India and come back after 2 months, using AP. What sort of questions being asked while entering USA and what documents I need to provide?
My friends are advising me not to leave the country. Please advise.

Now things are not predictable. I prefer premium process with an extra 1000 USD
