My parents will be visiting us here soon, and when they return, we want to see if we can send kids to India (2 and 5yrs). Kids have never been to India, and I would like to know which is a better option and why. Greatly appreciate your advice.

A new visa bulletin gets released every month sometime during second week. Keep checking for your date and when it becomes current, you can apply for I485 and if need be you can apply for EAD and/or AP.
Check the bulletin to have an idea on how long you will have to wait.

Hi Gurus,
I am in my 9th year H1-B. I have my I-140 approved and I-485 pending since July 2007 through employer A (EB-3).
Employer B is willing to hire me on H1-B (transfer) using AC21 portability (and similarity of jobs). After the move, employer A will revoke my I-140 for sure.
Can I apply for an H1-B transfer with employer C after a year or two using AC21 portability? I do not want to use EAD. I want to use H1-B tansfer (3 year extensions)?
This is a major decision that I have to make.
Please reply at your earliest convenience.

Hi ,
1.My wife works for part ime H1b. She has her H1B till Aug 2011. She would Like to apply for her GC. Can she apply for labor certification with part time job? She can get a full time job after she gets in to adjustment of status. She doesn't want full time job now as our kids are still small.
2.I have a fulltime H1B and Approved I-140 EB2. PD sept 2007, waiting for retrogression to file 485!!!! god know when that will happen.Can I apply for EB1 while my EB2 pending?

Folks,
We received letter from USCIS NSC saying that our AP (incl. my spouse) were approved on 10/15/08. On 11/17/08 we received RFE on my spouse AP application for photos. My wife had already left for India (11/15/08) assuming that our AP was approved. Anyways.
My question - If NSC approves her AP application (again), which date will she have on her approved AP application (i.e will the date be still 10/15/08 OR after the RFE response for photos). Photos were received at the NSC on 11/26/08.
Is anyone in the same situation. Your input is much appreciated.

Hello
I am in AOS with priority date of EB2 Dec 2006. We are moving out of USA due to spouse getting a job outside of USA. If we want to retain our priority date and green card, what are we supposed to do before and after we leave USA?
In case we want to make temporary visits to the USA, do we have to apply for visitor visa? I am assuming that we will not have AP since we are not inside USA. Will we even get a visitor/business visa since we have an immigrant visa which is pending with USCIS?

Hi,
My employers are considering transfering me to another group company (different name) during the next 1-2 months. My job profile will remain unchanged, but the employer name/address (on paychecks, etc) will be different after the transfer. My I-140 is still pending (filed in Aug 2007 together with I-485 at NSC under EB-3).
I'd greatly appreciate anyone's advice on the following:
a) If I transfer before my I-140 is approved, do I need to notify USCIS in writing? If so, does any specific paperwork need to be filled out? My employers have assured me they will continue to support my I-140/485 under the original company name, for as long as required.
b) If I transfer after approval of I-140 (fingers crossed!), do I need to notify USCIS? Again, is any specific paperwork necessary?

I need an advice.
I was in US since Apr 1999. FIled for GC in oct 2000. I got my I-140 approved.But then i had to go back to india as my company transferred me to india office in Oct 2001.
I left that company in jan 2004 and joined another company in india. Then in July 2004 i came back to US thru a consulting firm. An din jan 2005 my client offered a job. So since Jan 2005 i am working at the cients office as their employee. I filed for LC in Sep 2005, it got approved in oct 2005 (Just mised by 3 weeks)
My question is was was it possible to use the PD from my previous GC. which is Oct 2000.My atternoy told me it is not possible. But i saw similer posting on IV, hence i am curious. Also if possible is there any way i can get the old GC at this stage,my I-140 is approved this time too.,

Well need some help. I moved from H1-B to F1 visa to do masters. Now I want to quit F1 in middle and go back to doing H1-B and continue masters part time.
I know there are still slots open for H1-B for 2010. Please correct me if I am wrong.
Now I can do summer internship untill August 26, the question is, how can I work for the employer for the month of September? since H1B starts on Oct 1st. I can do CPT full time but, then again I heard you can not quit CPT in middle of the semester.
Any suggestions will be greatly appreciated.

I filed my I-140 at NSC, but when I check case status online it says my I-140 was transfered to another Service center. It does not say which Service center though. My lawyer says he got all his mails form CSC, which means my I-140 is pending at CSC. Also my case number starts with WAC-XXX-XXXX, which also suggests that my case is pending at CSC. However, I am not convinced if this is correct because CSC does not publish processing times for I-140. Also, recently when I filed AR-11 for an address change I got an email from USCIS with the address of TSC on it. I would like to know if anyone is in the same boat and knows which service center there case is. I will appreciate your feedback.
